General Terms and Conditions (GTC) of Templatestore Lynn

§Scope of application

The following General Terms and Conditions (GTC) apply to all orders placed via our website.

The offer on this website is aimed exclusively at consumers residing in Switzerland and Liechtenstein (hereinafter "Customer").

A consumer is a natural person who maintains business relations with Templatestore Lynn (hereinafter "AQUATANA") that cannot be attributed to their commercial or independent professional activity. Orders in non-household quantities may be rejected without justification.

AQUATANA reserves the right to amend these GTC at any time. The version of these GTC applicable at the time of the order shall be authoritative and cannot be unilaterally amended for this order. Any terms and conditions of the customer that conflict with or deviate from these GTC are not recognised.

The operator of this website is AQUATANA (Imprint).

§Information on this website

AQUATANA contains information about products and services. Prices, product ranges and technical specifications are subject to change without notice. All information on this website (product descriptions, images, illustrations, films, dimensions, weights, technical specifications, accessory relationships and other information) are for illustrative purposes and are to be understood as approximate values and are non-binding. In particular, they do not constitute an assurance of properties or guarantees, unless explicitly stated otherwise. AQUATANA endeavours to ensure that all details and information on this website are correct, complete, up-to-date and clear, but AQUATANA cannot provide any express or implied warranty in this respect.

All offers on this website are subject to change and are not to be understood as a binding offer.

AQUATANA cannot guarantee that the products listed will be available at the time of ordering. Therefore, all information on availability and delivery times is without guarantee and may change at any time and without notice.

§Prices

The sales prices stated on the AQUATANA website are final prices and, unless otherwise stated, include statutory VAT and any other statutory charges such as advance recycling fees (VRG) or copyright levies for electronic devices. Prices are quoted net in Swiss francs (CHF).

Unless otherwise stated, any shipping costs will be charged additionally and must be paid by the customer. Shipping costs are shown separately in the order process.

Technical changes, errors and misprints excepted; in particular, AQUATANA may make price changes at any time and without prior notice. Consultancy and support services are not included in the sales prices.

§Conclusion of contract

The products and prices on this website are non-binding offers.

By placing an order via this website, including acceptance of these GTC, the customer submits a legally binding offer to conclude a contract. AQUATANA then sends an automatic order confirmation by e-mail, which confirms that the customer's offer has been received by AQUATANA. Orders placed are binding for the customer. Unless otherwise stated, there is no right of return or cancellation.

The contract is concluded as soon as AQUATANA sends a declaration of acceptance by e-mail confirming the dispatch of the ordered products or services. Orders will only be dispatched after full payment has been received (exception: delivery against invoice) and if the goods are available. If it transpires that the ordered goods cannot be delivered or cannot be delivered in full, AQUATANA shall be entitled not to accept or only partially accept or fulfil the order. In such a case, AQUATANA will inform the customer by e-mail. If the customer's payment has already been received by AQUATANA, the payment will be refunded to the customer. If no payment has yet been made, the customer shall be released from the obligation to pay.

§Payment options and retention of title

The payment options specified in the order process are available to the customer. The following payment options are currently available:

  • Google Pay
  • shopPay
  • Pay in advance

If the customer has selected the payment method "invoice", which is available for a shopping basket value of CHF 35.00 to CHF 400.00, the customer's personal data will be forwarded to Intrum AG after the order for the purpose of a credit check and may be stored there.

The Data protection provisions of Intrum AG also apply here.

In the event of a negative credit rating, the order placed is automatically cancelled and the customer is informed by email. The payment term for purchase on account is 14 days after receipt of the invoice.

If the customer has selected the payment method "Prepayment", the order will be dispatched to the customer after successful receipt of payment. The payment term for advance payment is 7 days.

AQUATANA reserves the right to exclude customers from individual payment options without giving reasons or to insist on payment in advance.

AQUATANA may charge default interest of 5% per year and a reminder fee of a maximum of CHF 20 per reminder if the customer is in default of payment.

The products delivered to the customer remain the property of AQUATANA until full payment has been made.

§Delivery, obligation to inspect, notification of defects and return

Deliveries are sent by Swiss Post or courier service to the address specified by the customer in the order.

AQUATANA endeavours to keep delivery times as short as possible. However, any delivery periods stated in the order confirmation are non-binding. AQUATANA is entitled to make partial deliveries. The customer shall not incur any additional costs for partial deliveries.

The invoice, if delivery against invoice is offered, shall be sent at AQUATANA's discretion by e-mail or by post.

If the delivery cannot be delivered or if the customer refuses to accept the delivery, AQUATANA may cancel the contract after notifying the customer by e-mail and granting a reasonable grace period, and may charge the customer for the costs of the inconvenience.

The customer is obliged to inspect the delivered goods immediately upon receipt of the delivery and to report any defects for which AQUATANA provides a warranty without delay using the form for returns and complaints.

Returns to AQUATANA are made at the customer's expense and risk. AQUATANA shall provide the customer with further information on returns and complaints, as well as the corresponding form, at the following link.

Returns that have not been requested by the customer via the form cannot be processed further by AQUATANA and will be returned at the customer's expense.

If the inspection by AQUATANA reveals that the goods have no detectable defects or that they are not covered by the manufacturer's warranty, AQUATANA may charge the customer for the labour, the return shipment or
any disposal.

§Right of cancellation

AQUATANA does not grant the customer any right of cancellation.

§Warranty

AQUATANA endeavours to deliver goods of perfect quality. In the event of defects notified in good time, AQUATANA warrants that the goods purchased by the customer are free from defects and functional for the statutory warranty period, which is generally two years from the date of delivery. It is at the discretion of AQUATANA to fulfil the warranty by repairing the item free of charge, replacing it with an equivalent item or refunding the purchase price. Further warranty rights are excluded.

The warranty does not cover normal wear and tear or the consequences of improper handling or damage by the customer or third parties or defects attributable to external circumstances. The warranty for consumables and wearing parts (e.g. batteries, rechargeable batteries, etc.) is also excluded.

AQUATANA is unable to provide any assurances or guarantees that the data is up-to-date, complete and correct or that the website, its functionalities, integrated hyperlinks and other content will be available at all times or without interruption. In particular, it is neither assured nor guaranteed that the use of the website will not infringe any rights of third parties that are not owned by AQUATANA.

§Liability

AQUATANA excludes all liability, irrespective of its legal basis, as well as claims for damages against AQUATANA and against any auxiliary persons and vicarious agents. In particular, AQUATANA shall not be liable for indirect damage and consequential damage, loss of profit or other personal injury, damage to property or pure financial loss suffered by the customer. Further mandatory statutory liability, for example for gross negligence or unlawful intent, remains reserved.

AQUATANA only uses hyperlinks to simplify the customer's access to other websites. AQUATANA cannot know the content of these websites in detail, nor can it assume any liability or other responsibility for the content of these websites.

§Data protection

AQUATANA may process and use the data collected during the conclusion of the contract to fulfil the obligations arising from the purchase contract and for marketing purposes. The data necessary for the fulfilment of the service may also be passed on to commissioned service partners (logistics partners) or other third parties.

§Validity of data

Should individual provisions of these GTC prove to be invalid or unenforceable or become invalid or unenforceable, this shall not affect the validity of the remaining provisions.

§Other provisions

AQUATANA expressly reserves the right to amend these GTC at any time and to bring them into force without prior notice.

In the event of disputes, exclusively substantive Swiss law shall apply to the exclusion of conflict of laws rules. The UN Convention on Contracts for the International Sale of Goods (CISG, Vienna Sales Convention) is explicitly excluded.
